Note: If such modifications or changes were made, the capacity, operation, and maintenance instruction plates, tags, or decals should have been changed accordingly. On or about July 21, 2022, at a construction site, the employer modified the Skyjack SJ843 II telehandler with a personal basket to lift employees to gain access onto the roof of a commercial building without the manufacturers written approval.

29 CFR 1926.760(a)(1):Each employee engaged in steel erection activity who is on a walking/ working surface with an unprotected side or edge more than 15 feet above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems. On or about July 21, 2022, on the roof of a commercial building located in Porter, Texas, employees were engaged in installing the roof with unprotected side and edges without a personal fall arrest system.
