29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition: (a) Fertilizer Bulk Building - Combustible fertilizer dust had accumulated on the floor, exposing employees to fire and explosion hazards, on or about June 21, 2022. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) The Fertrell Company, 600 North 2nd Street, Bainbridge, Pennsylvania - Employees had exposure to hazardous chemicals in the workplace, including, but not limited to dry fertilizer (which present physical hazards of fire and explosion), and the employer did not develop, implement, and maintain a written hazard communication program, on or about July 21, 2022. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
