29 CFR 1903.19(c)(1):  Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  The employer failed to provide certification of abatement for five citations issued on September 2, 2022, with citation 1 item 1a related inappropriate use of body belts as part of a fall arrest system, citation 1 item 1b related to improperly installed anchorage, citation 1 item 1c related to providing required fall protection safety training, citation 1 item 2a related to portable ladders not extending 3 feet above the landing surface, and citation 1 item 2b related to providing required ladder safety training.

29 CFR  1926.502(d):  "Personal fall arrest systems." Personal fall arrest systems and their use shall comply with the provisions set forth below. Effective January 1, 1998, body belts are not acceptable as part of a personal fall arrest system. Note: The use of a body belt in a positioning device system is acceptable and is regulated under paragraph (e) of this section.  On or about July 13, 2022, at a jobsite located at 4605 N Suncastle Ct, in Appleton, Wisconsin; employees were using body belts as part of a fall arrest system while engaged in residential roofing operations approximately 10 to 22 feet above ground.    The use of a body belt exposes the employee to fall hazards, including internal injuries, in the event of a fall.

29 CFR  1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows:  On or about July 13, 2022, at a jobsite located at 4605 N Suncastle Ct, in Appleton, Wisconsin; employees were installing shingles on the roof of an existing residential home without the use of proper anchorage, thereby exposing employees to fall hazards of between 10 and 22 feet.

29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.   On or about July 13, 2022, at a jobsite located at 4605 N Suncastle Ct, in Appleton, Wisconsin; the extension ladder located at the front of the house used to access the existing residential roof did not extend at least three feet exposing employees to slip and trip hazards of approximately 12 feet.
