29 CFR  1926.102(a)(1): Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:   (a) At worksite location, 115 Waterman Ave., Johnston, RI:   On or about July 11, 2022, employees were not wearing protective eye wear.  An employee was observed using a power drill and portable power hand saw (Skil saw) on lumber.

29 CFR  1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:    (a) At worksite location, 115 Waterman Ave., Johnston, RI: On or about July 11, 2022, employees were observed using an extension ladder that did not extend 3 feet beyond the upper landing on the second floor and it was not secured.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    (a) At worksite location, 115 Waterman Ave., Johnston, RI:   On or about July 11, 2022, two employees were not protected from falling while working on an upper level of a residential house approximately 25 feet  to ground level and 10 feet above the lower inside floor level.  Eli Construction Inc.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1529932, citation number 1, item number 2 and was affirmed as a final order on October 5, 2021, with respect to a workplace located at 91 Cedar Street in Pawtucket, RI.

(a) At worksite location, 115 Waterman Ave., Johnston, RI:   On or about July 11, 2022, the employer had not completed written fall protection training certification records for all employees who were exposed to fall hazards.    Abatement Note: The written certification record shall contain the following: 1.  The name or other identity of the employee trained; 2.   The date(s) of the training; and  3.   The signature of the person who conducted the training or the signature of the employer.   Eli Construction Inc.  was previously cited for a violation of this occupational safety and health standard, 29 CFR 1926.503(b)(1), which was contained in OSHA inspection number 1529932, citation number 2, item number 1 and was affirmed as a final order on October 5, 2021 with respect to a workplace located at 91 Cedar Street in Pawtucket, RI.
