29 CFR 1926.20(b)(1):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a)Elite Granillo Restoration, Inc. at 103 North Main Avenue, Hartford, SD 57033: On or about and at times prior to July 25, 2022, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person.  Employees were exposed to fall hazards as a result of conducting masonry parapet wall repair activities without the use of a fall protection system, fall hazards associated with improper use of ladders and scaffolds, and lack of safety training. This condition exposed employees to a variety of hazards identified on site.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR  1926.451(g)(1):Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  (a)Elite Granillo Restoration, Inc. at 103 North Main Avenue, Hartford, SD 57033: On or about and at times prior to July 25, 2022, the exposing employer did not ensure that employees were protected from falls while conducting masonry parapet wall repair activities while standing and climbing on the railing of a scaffold platform on the north side wall of a commercial building. The employees were climbing on a scaffold platform railing which was raised more than 25 feet high by a 2018 Mec Aerial Platform Sales Corporation, Serial number 11800300 scissor lift system to gain access to the roof of the property and employees were not using a personal fall protective system. This condition exposed the employees to fall hazards greater than ten feet.

Fiberglass Stepladder, Model Number: 100531, Type IA the employees were using to access the upper landing surface of the west eave of a commercial building roof was installed and used correctly in that employees were permitted to stand on the top or top step of the stepladder while it was leaning against the west wall of the commercial building. This condition exposed employees to fall hazards greater than six feet.
