29 CFR  1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  (a) On or about July 28, 2022, the employer did not develop and implement a hazardous energy control program, and provide employees training on the program. This exposed employees to crushing, caught-in and amputation hazards.

29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a) On or about July 28, 2022, the company did not provide each authorized forklift operator with training and evaluation of competency prior to allowing employees to operate forklifts at the facility. This exposed employees to struck-by, caught-in-between and crushing hazards.

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) At this location, employees engaged in landscaping operations and machine repair/maintenance were exposed to hazardous materials, such as but not limited to, oils, gasoline, and lubricants. The employer had not developed and implemented a program which would address labeling and other forms of warnings on hazardous material containers, Safety Data Sheets, and employee information and training on the hazards associated with the hazardous materials utilized on site, and is consistent with Globally Harmonized System (29 CFR 191200(a)(1)).  The written program must also contain the following: 1. A list of all hazardous materials on site; 2. The methods the employer will use to inform employees of the hazards associated with non-routine tasks involving hazardous materials, such as spills; 3. The hazards of the materials contained in piping that is not labeled, and; 4. The method the employer will use to inform other employers (contractors) of the chemicals their employees might be exposed to while performing duties at the site.
