29 CFR 1926.453(b)(2)(v):A body belt (harness) was worn and a lanyard was not attached to the boom or basket when working from an aerial lift: a) On or about 07/27/2022, during the pointing process of brick masonry exterior of the Kistner Concrete Building, located at 10 Ellicott Street, in Batavia, New York, the employer did not enforce the use of fall protection to employees working in the basket of an aerial boom lift, 14 feet above lower levels. Employees were allowed to work in an articulating boom without the proper use of Personal Fall Arrest Systems such as "tying off" to the boom basket with a lanyard. NO ABATEMENT CERTIFICATION REQUIRED
