29 CFR  1910.28(b)(2)(i): Employee(s) in a hoist area were not protected from falling 4 feet (1.2 m) or more to a lower level by a guardrail system, a personal fall arrest system, or a travel restraint system:  a)Blending Room, Second Floor: On or about July 28, 2022 the employer did not ensure that employees working on the second level of the blending room were protected from falling approximately 14 feet to the lower level. Employees open the sliding gate, direct the forklift and retrieve/remove items from pallets hoisted by the forklift to Doors 1, 2 and 3.  In accordance with 29 CFR 1903.19 (d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstration that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of purchase or repair of equipment, photographic or video evidence of abatement or other written records.

No abatement certification is required for this item.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:   a) On or about July 28, 2022, Radienz Living Chicago, LLC, did not ensure that an employee who conducted batch mixing operations, and was required to use 3M 7502 series air purifying half-face respirators, did not have facial hair which came between the face and the sealing surface of the facepiece.
