29 CFR 1910.178(l)(4)(iii):An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years. On or about July 28, 2022, the employer did not ensure that the performance of all employees operating powered industrial vehicles, including but not limited to forklifts, were evaluated at least once every three years. Employees were exposed to struck-by hazards likely to result in serious injury due to lack of training in the knowledge and skills needed to safely operate forklifts. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.178(l)(6):Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. On or about July 28, 2022, the employer did not ensure that employees who were authorized to operate powered industrial vehicles, including forklifts, were certified. The employees had not been trained and evaluated as required, exposing them to struck-by hazards likely to result in serious injury due to lack of training in the knowledge and skills needed to safely operate forklifts. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
