29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling: a. On or about July 27, 2022, at the south load station, an employee was exposed to fall hazards of approximately ten (10') feet nine (9") inches when required to access the top of a truck to performing loading operations. The employee had not been provided with or required to use a personal fall arrest system.

29 CFR 1910.30(a)(3): The employer did not train each employee as required by 1910.30(a)(3)(i)-(iv) including recognizing and minimizing fall hazards; correct procedures for installing, inspecting, operating, maintaining, and disassembling the personal fall protection systems; proper hook-up, anchoring, and tie-off techniques, and methods of equipment inspection and storage, as specified by the manufacturer: a. On or about July 27, 2022, at the south load station, an employee was exposed to fall hazards of approximately ten (10') feet nine (9") inches when required to access the top of a truck to performing loading operations. The employer did not provide fall protection training when working at heights indicative of a fall hazard. b. On or about September 29, 2022, at the north load station, employees were exposed to fall hazards of approximately ten (10') feet nine (9") inches when required to access the top of a truck to performing loading operations. The employees were equipped with fall protection, a harness and a shock absorbing lanyard, but were not provided effective fall protection training.
