29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a) On July 28, 2022, the creating, exposing, and correcting employer did not ensure that a daily inspection of the excavation and adjacent area was made by the competent person for evidence of hazardous conditions in that an employee worked at the bottom of the trench on a main water pipe as well as adjusted squeegee with a shovel without an adequate protective system. The trench was approximately 5 feet 10 inches in depth, had near vertical walls, type B soil, and visible cracks and fissures, as well as sections of soil sloughing into the trench. In addition, there was no safe means of egress. This condition exposed employees to a crushing hazard by excavation wall cave-in. Abatement Note: "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) On July 28, 2022, the creating, exposing, and correcting employer did not ensure that employees who were working inside a trench that was approximately 5 feet 10 inches in depth were protected by an adequate protective system. An employee worked at the bottom of the trench on a main water pipe as well as adjusted squeegee with a shovel. The trench had near vertical walls, type B soil, and visible cracks and fissures as well as sections of soil sloughing into the trench. This condition exposed employees to a crushing hazard by excavation wall cave-in.

An employee worked at the bottom of the trench on a main water pipe as well as adjusted squeegee with a shovel.
