OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to struck-by hazards. On August 01, 2022 at the jobsite located at 905 East Main Street, Mandan, North Dakota, where the employer had employees using a Bobcat Model 773 skid steer equipped with forklift tines to move a two-post vehicle lift. The vehicle lift slipped off the forks and rolled off the end, striking an employee resulting in serious injuries. Among other methods, feasible and acceptable methods to correct this hazard includes, but are not limited to the following: 1. Provide operator training to employees to address the hazards associated with operating skid steers per NIOSH Publication 2001-128, and ANSI B56.1 1969. 2. Follow the manufacturer's operating manuals for the Bobcat Skid Steer and the Forward Lift. 3. Develop and implement procedures to safely operate the skid steer for all types of operations.
