29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:   On or about August 2, 2022, employees performing duties such as but not limited to painting furniture parts with dry powder coating were required to wear 3M 5301 Half-Face Organic Vapor respirators throughout the duration of the working shift. The employer did not have a written respiratory protection program in place.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  On or about August 2, 2022, employees performing duties such as but not limited to painting furniture parts with dry powder coating were required to wear a 3M 5301 Half-Face Organic Vapor respirators throughout the duration of a working shift, without having first received medical evaluations.

29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals:  On or about August 2, 2022, a 3M 5301 Half-Face Organic Vapor respirator was stored unprotected hanging on a door handle outside the paint booth when not in use.

29 CFR 1910.1200(e)(1): The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met:  On or about August 2, 2022, employees used chemical products such as, but not limited to Interpon AN400QF INT 100 Midnight Black Wrinkle U1556-1 dry powder coating paint.  The employer did not implement a written chemical hazard communication program.
