29 CFR 1910.134(c)(1): The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use:  On or about August 2nd, 2022, the employer failed to implement an adequate, effective written respiratory protection program for employees performing painting operations for all provisions in 29 CFR 1910.134 (c)(1)(i)-(ix) with worksite specific procedures. Failure to implement an effective respiratory protection program exposes employees to adverse health effects ranging from acute respiratory illnesses to chronic pulmonary illnesses such as asthma, emphysema, and other illnesses.

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace:  On or about August 2, 2022, and at times thereafter, employees were required to wear respiratory protection while performing painting operations without having been provided a medical evaluation. Employees were potentially exposed to aggravation of preexisting medical conditions by the employer failing to have them medically evaluated prior to wearing a respirator.

29 CFR  1910.134(f)(1):The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):  On or about August 2nd, 2022, the employer failed to ensure employees who were required to wear a tight-fitting respirator were fit tested to determine if the respirator seal was adequate. Employees are exposed to respirable particulates while performing painting operations. Failure to provide fit tests exposes employees to adverse respiratory health effects by not being certified to wear a respirator.

29 CFR  1910.134(h)(4):Respirators that failed an inspection or were otherwise found to be defective were not removed from service and discarded or repaired:  On or about August 2nd, 2022, the employer failed to repair, discard, or remove from service respirators that are defective. Employees utilize a PAPR, in conjunction with the Blast One media blaster Model 65 CF, S/n 24L-7550 for respiratory protection.   The hood had painters tape covering the coupling to reduce a leak to the airline coupler.  Failure to remove the PAPR hood exposes employees to chronic and acute respiratory illnesses innate to coal slag media blasting.

29 CFR  1910.134(k)(1)(v):The employer did not ensure that each user could demonstrate knowledge of the procedures for respirator maintenance and storage:  On or about August 2nd, 2022, the employer failed to train employees on the procedures for maintenance and storage of respirators. Employees don respirators, to include Half-Face Air Purifying Respirators, Full-Face Air Purifying Respirators, and Power Air Purifying Respirators as part of their respiratory protection. Several respirators were found stored not in accordance with manufacturers recommendations. Failure to ensure employees were adequately trained on the procedures for maintenance and storage of respirators compromises the integrity and protection factor of the respirator.

29 CFR  1910.1200(h)(1):The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area:  On or about August 2nd, 2022, the employer did not adequately train employees on the chemical hazards present in their workplace. Employees were exposed to chemical hazards, to include Xylene, Glycol Ether, and Secondary Butyl Alcohol that are associated with painting and priming operations. Failure to adequately train employees on hazardous chemicals within their work center precludes the employee from understanding how to effectively mitigate a chemical spill or splash.
