29 CFR  1926.651(h)(1): Employees worked in excavations in which there was accumulated water, or in excavations in which water was accumulating, without adequate precautions taken to protect employees against the hazards posed by water accumulation:  (a)TE Underground LLC at East Arrowhead Parkway and South Six Mile Road, Sioux Falls, SD 57110:  On or about and at times prior to August 2, 2022, the employer did not ensure that employees were protected against the hazards associated with working in excavations with water accumulation by using either special support systems, water removal systems, or safety harnesses with lifelines.  This condition exposed employees to cave-in hazards associated with trench wall cave-in.

29 CFR  1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations:   (a)TE Underground LLC at East Arrowhead Parkway and South Six Mile Road, Sioux Falls, SD 57110: On or about and at times prior to August 2, 2022, the employer did not ensure that employees were protected from injury in that the spoil pile on the east wall of the trench was not placed at least two feet from the trench to prevent material from rolling into the excavation. This condition exposed employees to struck-by and cave-in hazards.

29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c):  (a)TE Underground LLC at East Arrowhead Parkway and South Six Mile Road, Sioux Falls, SD 57110:  On or about and at times prior to August 2, 2022, the employer did not ensure that employees were protected from cave-in hazards by an adequate protective system while working within an excavation that measured greater than five feet in depth.  This condition exposed employees to cave-in and struck-by hazards associated with excavation wall collapse.

29 CFR  1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:  (a)TE Underground LLC at East Arrowhead Parkway and South Six Mile Road, Sioux Falls, SD 57110:  On or about and at times prior to August 2, 2022, the employer did not ensure that the competent person removed employees from the excavation when evidence of a situation that could have resulted in possible cave-ins of the excavation was identified.  This condition exposed employees to cave-in hazards associated with trench wall cave-in.
