29 CFR  1910.133(a)(1):The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a) Spray area - On or about August 2, 2022, employees used a hazardous chemical to spray paint vehicles and the employer did not provide appropriate eye protection in accordance with this section.  Abatement certification required within 15 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) Spray area - On or about August 2, 2022, the employer provided and required employees to wear  half-face (3M 01793) and full-face elastomeric air purifying respirators (Versaflow M-200) and the employer did not provide employees a medical evaluation in accordance with this section.  Abatement certification required within 15 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR  1910.134(f)(2):Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator:  a) Spray area - On or about August 2, 2022, the employer provided and required employees to wear half-face (3M 01793) and full-face elastomeric air purifying respirators (versaflow M-200) and the employer did not fit-test employees prior to initial use and annually in accordance with this section.   Abatement certification required within 15 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    a)  Spray area - On or about August 2, 2022, employees used hazardous chemicals, including, but limited to Ez Coat 62253, Ez Coat  62273, and Heavy Duty Laquer Thinner 5825; and the employer did not provide training on hazardous chemicals in accordance with this section.    Abatement certification required within 15 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
