29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) and as referenced by the note contained in 1926.602(d):   (a) Hillandale Gettysburg LP, 370 Spicer Road, Gettysburg, Pennsylvania - The employer did not provide training and evaluation on powered industrial trucks as required by the standard to employees and permitted employees to operate a Genie GTH844 forklift, exposing employees to hazards including, but not limited to, tip-over, crushing, and struck-by, on or about July 28, 2022.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR  1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:   (a) Hillandale Gettysburg LP, 370 Spicer Road, Gettysburg, Pennsylvania - Employees used a personnel basket/platform on the forks of a Genie GTH844 forklift, and the employer did not get the forklift manufacturer's prior written approval to use this attachment, exposing employees to the exposing employees to hazards, such as overloading the forklift or dropping the personnel platform/basket and its occupants, on or about July 28, 2022.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR  1926.850(a): An engineering survey was not performed by a competent person to determine the condition of the framing, floors, and walls, and the possibility of unplanned collapse of any portion of the structure prior to permitting employees to start demolition operations:  (a) Hillandale Gettysburg LP, 370 Spicer Road, Gettysburg, Pennsylvania - Prior to employees starting demolition operations on the six commercial poultry houses, the employer did not have an engineering survey of any of the buildings performed, exposing employees to struck-by hazards from a building collapse, on or about July 29, 2022.  Abatement certification and documentation are required within 10 days after the abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement, or other written records.
