1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a) North of the intersection of Waterfront Drive and Indian Mission Road (adjacent to Stonewater Creek Development), Millsboro, DE: On or about 08/02/2022, the employer failed to ensure a ladder or other safe means of egress was located in a trench/excavation that was alongside a high speed roadway (50 mph). The trench/excavation measured 16 feet long, 8 feet wide, and 4 foot 6 inches deep on the east side of the trench and 5 feet 4 inches deep on the west side.

1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) North of the intersection of Waterfront Drive and Indian Mission Road (adjacent to Stonewater Creek Development), Millsboro, DE: On or about 08/02/2022, the employer failed to protect employees working in a trench by an adequate protective system. Employees engaged in trenching and excavating work to add a new electrical connection to a new multi-unit development. The competent person required employees to enter and work in a trench/excavation with no trench box, nor benching/sloping measures in place to prevent employees from being exposed to cave in hazards. The trench/excavation measured 16 feet long, 8 feet wide, and 4 foot 6 inches deep on the east side of the trench and 5 feet 4 inches deep on the west side with loose soil all around from previous site work.
