29 CFR  1926.25(a):  During the course of construction, alteration, or repairs, form and scrap lumber with protruding nails, and all other debris was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures:  At the Gateway Woods apartment project, around Building #5 where Benjamin Fulton employees were exposed to trip hazards and puncture hazards as they stepped onto or over piles of boards that had been used as bracing, some with nails sticking up, to enter the building so that they could gain access to the roof.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system:  At the Gateway Woods apartment project, on building #5 where employees of the roofing contractor were installing shingles without utilizing any form of fall protection.  This practice exposed the employees to the hazard of falling from the roof to the ground below.

29 CFR  1926.502(d)(15): Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as follows: As part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person:   At the Gateway Woods apartment project, on building #5, where five employees of  the roofing contractor were utilizing two roof anchors, installed parallel to the ridgeline, for their anchoring points instead of a single anchor each, installed over the ridge line and screwed into a roof truss.  This practice exposed the employees to the hazard of falling from the roof to the ground below.

29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii):   At the Gateway Woods apartment project, on building #5, where five employees of  the roofing contractor were utilizing two roof anchors, installed parallel to the ridgeline, for their anchoring points instead of a single anchor each, installed over the ridge line and screwed into a roof truss.  This practice exposed the employees to the hazard of falling from the roof to the ground below.
