29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) B H & D CONSTRUCTION LLC located at Lot 1980, Newark, Ohio 43055: On and preceding August 2, 2022, the employer did not develop and maintain an effective safety and health program to ensure that hazards were identified and corrected onsite while employees performed framing work which exposed them to fall and struck-by hazards.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) B H & D CONSTRUCTION LLC located at Glassboro Street, Lot 1980, Newark, Ohio 43055: On and preceding August 2, 2022, the employer did not ensure employees who were exposed to struck-by hazards to the eyes were required to wear eye protection. Employees, without eye protection, used pneumatic nail guns and powered saws, thereby being exposed to struck-by hazards.

The path to ground from circuits, equipment, and enclosures shall be permanent and continuous.  a) B H & D CONSTRUCTION LLC located at Glassboro Street, Lot 1980, Newark, Ohio 43055: On and preceding August 2, 2022, the employer did not ensure employees used extension cords that had a continuous path to ground. Employees used a Rolair air compressor where the power cord was missing the ground prong, thereby exposing employees to 119-volt electrical contact hazards.  b) B H & D CONSTRUCTION LLC located at Glassboro Street, Lot 1980, Newark, Ohio 43055: On and preceding August 2, 2022, the employer did not ensure employees used extension cords that had a continuous path to ground. Employees used a DeWalt air compressor where the power cord was missing the ground prong, thereby exposing employees to 119-volt electrical contact hazards.

Flexible cords used with temporary and portable lights shall be designed for hard or extra-hard usage.  a) B H & D CONSTRUCTION LLC located at Glassboro Street, Lot 1980, Newark, Ohio 43055: On and preceding August 2, 2022, the employer did not ensure employees used three wire extension cords that were designed for hard or extra-hard usage. Employees used a two-wire extension cord to provided electrical power to portable tools, thereby exposing employees to 119-volt electrical contact hazards.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a) B H & D CONSTRUCTION LLC located at Glassboro Street, Lot 1980, Newark, Ohio 43055: On and preceding August 2, 2022, the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Framers were working on the second story of a two-story residential home at heights up to 28 feet. The employees were not utilizing any form of fall protection which exposed them to falls hazards of 28 feet.
