29 CFR 1910.178(p)(1):Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s). On or about August 8, 2022, the employer failed to remove forklifts from service after multiple deficiencies had been identified. The Yellow- Hyster Fortis 120 lift truck model S120FTPRS Serial No. G004V06507K did not have a functioning seatbelt and badly worn tread on the tires (rear tires) . The Mitsubishi - F140 Serial No. AF19B-00468 Forklift did not have a functioning horn and a faulty left top headlight. These conditions exposed employees working in the area to struck-by hazards. No abatement certification or documentation is required for this item.
