29 CFR  1910.28(b)(1)(i):  Except as provided elsewhere in this section, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling:   a) Job site, 2551 Champion Drive, Claysburg, PA: On or about August 1, 2022, during production activities in the Side Metal Department, the employer did not ensure that employees were protected from fall hazards of up to approximately 13 feet in height while working on the top of a home component under construction.

29 CFR  1910.28(b)(11)(ii): The employer did not ensure that each flight of stairs having at least 3 treads and at least 4 risers was equipped with stair rail systems and handrails (see TABLE D-2):   a) Job site, 2551 Champion Drive, Claysburg, PA: On or about August  8, 2022, during production activities in the Side Metal Department, the employer did not ensure that a set of stairs that had at least 10 tread and 10 risers was equipped with a proper stair rail system in that the rail system lacked a midrail.

29 CFR  1926.451(d)(16): In addition to the normal operating brake, the suspension scaffold power-operated hoist and did not have a braking device or locking pawl which engaged automatically when the hoist made an uncontrolled movement either in an instantaneous change in momentum or an accelerated overspeed:   a) Job site, 2551 Champion Drive, Claysburg, PA: On or about August 1, 2022, during production activities in the Side Metal Department, the employer did not ensure that a power operated hoist scaffold system was equipped with the minimum safety features to prevent it from falling to ground level in the event of an unexpected change in momentum or speed. A scaffold component broke, allowing the scaffold system to fall to the production floor due to the lack of a brake or an automatically engaging device being present on the unit that would have stopped it from doing so.
