29 CFR 1926.651(j)(2):Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a) West Expo Parkway - On or about August 9, 2022, employees performed repairs to storm sewer pipe working in an excavation that was up to seven (7) feet deep. The excavated spoil pile was placed at the top of the excavation wall and was not placed at least two (2) feet away, exposing employees to struck-by hazards from rolling or sliding material.
