Fort Recovery OH 45846, did not have a plan or a program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls and struck by hazards during job site operations, decreasing the probability of employee injury or illness.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. On or about August 4, 2022, the employer Wuebker Construction LLC at the jobsite located at 1867 Watkins Rd. Fort Recovery OH 45846, did not ensure employees working from a SkyJack mobile scaffold (scissor lift) (model SJ8243/Serial Number 34001471) were adequately trained in the recognition of hazards associated with this type of mobile scaffold. Untrained employees operating the unit in this condition were exposed to operational hazards, such as but not limited to, falls from height.

29 CFR 1926.100(a):Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: On or about August 4, 2022, the employer Wuebker Construction LLC at the jobsite located at 1867 Watkins Rd. Fort Recovery OH 45846, did not ensure that employees were protected from head injury by protective hardhats while working directly below and under employees who were hanging metal wall covering from an elevated scissor lift. One employee was exposed to potential struck by injuries caused by falling construction debris, including sheets of metal wall sheeting material which could have fallen from heights to the employees working below.

Fort Recovery OH 45846, did not ensure that employees were protected from falls while operating a SkyJack mobile scaffold (scissor lift) (model SJ8243/Serial Number 34001471). Employees were exposed to falls of approximately 15 feet to the ground below while installing metal wall covering materials without the benefit and use of personal fall arrest systems, or guardrail systems.
