OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  a) Jobsite: 1546 Sherman Ave.  Canon City, CO 81212: On or about July 20, 2022, the employer, Colorado Tree Solutions, LLC, did not ensure employees were protected from struck-by hazards during the removal of an elm tree.   An employee was struck by an uncontrolled, felled tree limb resulting in the death of that employee.  Abatement Note:  Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident:  a) Jobsite: 1546 Sherman Ave.  Canon City, CO 81212: On or about July 23, 2022, an employee of Colorado Tree Solutions, LLC, passed away due to a tree-trimming incident that occurred on July 20, 2022.  The death was not reported to the OSHA Englewood Area Office until August 4, 2022, by the Fremont County Coroner in Canon City, Colorado.

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:  a)  Jobsite: 1546 Sherman Ave.  Canon City, CO 81212: On or about July 20, 2022, the employer, Colorado Tree Solutions, LLC, did not ensure that affected employees wore a protective helmet while in the performance of felling trees and clearing associated limbs from the ground, especially in the "drop zone".  On this date, an employee, who was not wearing a protective helmet, was struck by an uncontrolled, felled tree limb resulting in the death of that employee.
