29 CFR  1910.29(b)(1):  The employer did not ensure that guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, that are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D11 of this section).   a)  On or about August 11, 2022, employees were exposed to fall hazards in the Fire Cache area due to a stair rail system that measured 30 inches from the leading edge of the stair tread to the top surface of the top rail.   b)  On or about August 11, 2022, employees were exposed to fall hazards in the Saw Cache due to the right-hand stair rail system that measured 38 inches from the leading edge of the stair tread to the top surface of the top rail.  c)  On or about August 11, 2022, employees were exposed to fall hazards in the Saw Cache due to the center stair rail system that measured 38 inches from the leading edge of the stair tread to the top surface of the top rail.

29 CFR 1910.29(b)(2)(i):  The employer did not ensure that guardrails met the requirement that midrails that are installed at a height midway between the top edge of the guardrail system and the walking-working surface.   a)  On or about August 11, 2022, employees were exposed to fall hazards in the Fire Cache due to a stair rail system that measured 30 inches from the leading edge of the stair tread to the top surface of the top rail with no midrails installed.   b)  On or about August 11, 2022, employees were exposed to fall hazards in the Saw Cache (right-hand stair case) due to a stair rail system that measured 38 inches from the leading edge of the stair tread to the top surface of the top rail with no midrails installed.   c)  On or about August 11, 2022, employees were exposed to fall hazards in the Saw Cache (center stair case) due to a stair rail system that measured 38 inches from the leading edge of the stair tread to the top surface of the top rail, but had no midrails installed.   d)  On or about August 11, 2022, employees were exposed to fall hazards in the Temporary housing area due to a stair rail system that measured 41 inches from the leading edge of the stair tread to the top surface of the top rail, but had no midrails installed.
