On or about August 8,2022, at 16460 Gulf Shore Dr., Boca Grande, FL, employees were using a stairway to access and elevated patio deck, wherein the stairway was comprised of four or more risers and/ or was rising more than 30 inches, and during which time the stairway did not have a stair rail system along each unprotected side or edge; therefore exposing the employees to a fall hazard.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a. On or about August 8,2022, at 16460 Gulf Shore Dr., Boca Grande, FL, employees conducting painting work from an elevated patio deck were exposed to a 8 feet 5 inch fall hazard, in that, the guard rails were removed and no other type of fall protection was used.
