29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required. 29 CFR  1910.178(l)(6):The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l):  On or about August 4, 2022 at jobsite located in 836 N. York Ave. Elmhurst, the employer did not ensure that employees who were authorized to operate the Pettibone lift truck were certified. The employee had not been trained and evaluated as required. No forklift training or certification has been conducted at the worksite.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR  1910.178(q)(1): Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel.  On or about August 4, 2022 at jobsite located in 836 N. York Ave. Elmhurst, IL., the employer did not remove from service as required the Pettibone Michigan Tractor Serial#60841CCC Model No. TL6035 that was not in safe operating condition. The seatbelt was defective, employees were exposed to crushing hazards and head injuries in the event of a lift truck tip over.    Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
