29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  As of February 23, 2023, the employer had not certified to OSHA within 10 calendar days that abatement was completed for the violation Citation 1 Item 1, Citation 1 Item 2, Citation 2 Item 1, from Inspection number 1614287, issued on November 29,2022 with a final order date of January 4, 2023.

29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  As of February 23, 2023, the employer had not submitted to the Agency documents that abatement had been completed for any serious violations indicated by the Agency included in Citation 1 Item 1, Citation 1 Item 2, Citation 2 Item 1 from inspection 1614287, issued November 29, 2022, with a final order date of January 4, 2023.

29 CFR  1926.501(b)(11):Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toe boards, safety net systems, or personal fall arrest systems:  161 Main Rd., Montgomery, MA: On or about August 12, 2022,  employees were observed working on a steep slope roof (6/12 slope) engaged in roofing activities  unprotected sides and edges greater than 21 feet to the next lower and were not protected by either guard rails, safety net systems or personal fall arrest systems exposing them to fall from height hazards.  Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19 (d) (1).  OGP Construction, LLC was previously cited for a violation of an equivalent standard 1926.501(b)(13) which was contained in OSHA inspection number 1584106, citation number 1, item number 1(c), and was affirmed as a final order on 12/4/22, with respect to a workplace located at 75 Stillwater Rd., Canton, MA.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee who might be exposed to fall hazards:  161 Main Rd., Montgomery, MA: On or about August 12, 2022,  employees were exposed to fall hazards as part of their assigned duties and the employer had not trained them prior to exposure to these hazards in topics such as but not limited to recognition of fall hazards, dangers of fall hazards and procedures each employee must take to prevent or minimize risk of such exposures.  Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19 (d) (1).  OGP Construction, LLC was previously cited for a violation of this occupational safety and health standard 1926.503 (a)(1), which was contained in OSHA inspection number 1584106 , citation  number 1 , item number 1b,  and was affirmed as a final order on  12/4/2022 with respect to a workplace located at 75 Still Water Rd., Canton, MA .

29 CFR  1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written certification record:  161 Main Rd., Montgomery, MA: On or about August 12, 2022 the employer had not prepared a written certification record of fall protection training which included the name or other identity of the person trained,  the signature of the person trained, date(s) the training was completed and the signature of the person who conducted the training.   Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19 (d) (1).
