29 CFR  1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   On or about August 9, 2022 and at times prior to, the employer did not require the installers or service technicians to use fall protection when installing the new systems or when servicing the previously installed systems.  This practice exposed the employees to the hazard of falling from the roof to the ground in the following instances:  a) Installing solar panel systems on the rooftops of customers' houses.  b) Performing trouble shooting activities on solar panel systems that have been installed on the rooftops of customers' houses.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   On or about August 9, 2022, untrained employees were exposed to the hazard of falling from the roof to the ground in the following instances:  a) Employees engaged in the installation of solar panel systems on the rooftops of customers' houses;  b) Employees engaged in the servicing of solar panel systems that had been previously installed on the rooftops of customer' houses.

29 CFR 1926.1060(a)(1)(iii): The employer did not ensure that each employee using ladders and/or stairways had been trained by a competent person in the proper construction, use, placement, and care in handling the ladders and/or stairways:   On or about August 9, 2022, untrained employees were exposed to the hazard of falling from the ladders or roof to the ground in the following instances where employees used ladders in carrying out their work activities: a) Employees engaged in the installation of solar panel systems on the rooftops of customers' houses; b) Employees engaged in the servicing of solar panel systems that had been previously installed on the rooftops of customer' houses.
