The employer did not ensure that when wet processes are used, drainage is be maintained and, to the extent feasible, dry standing places, such as false floors, platforms, and mats are provided:  Midwest Tire Disposal, main work area: On or about 12 August 2022 and 4 November 2022, the concrete floor and stairway around and adjacent to the Artech MDE 250-63 Shredding System was saturated with water, dirt and debris.

29 CFR 1910.22(a)(3): The employer did not ensure that walking-working surfaces are maintained free of hazards such as sharp or protruding objects, loose boards, corrosion, leaks, spills, snow, and ice:  Midwest Tire Disposal, main work area, stairway to top of shredder: On or about 12 August 2022 and 4 November 2022, the six stairs from the floor to the top of the stairway on the Artech MDE 250-63 Shredding System was covered in an oily residue, tire shards and water.  Additionally, wires were also discovered on the concrete floor inside as well as outside near the west side of the building.

The platform consists of 3 sections with serrated steel bar grating tread and debossed holes on metal grating with traction buttons.

Midwest Tire Disposal, main work area, platform at top of shredder: On or about 12 August 2022 and 4 November 2022, there were no midrails, screens, mesh, intermediate vertical members, solid panels, or equivalent intermediate members installed between the walking-working surface and the top edge of the platform guardrail system located on the Artech MDE 250-63 Shredding System. The platform consists of 3 sections with serrated steel bar grating tread and debossed holes on metal grating with traction buttons with a top rail only.

The platform consists of 3 sections with serrated steel bar grating tread and debossed holes on metal grating with traction buttons with no toeboards or midrails to protect the shredder operator below.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  Midwest Tire Disposal, main work area, conveyor belt on front of shredder: On or about 12 August 2022 and 4 November 2022, employees were exposed to ingoing nip points and pinch points on the conveyor belt where employees remove tires from a truck and place it on the belt. There are rotating support rollers on the top and underside of the conveyor belt that have unguarded in-running nip points between the support rollers and belt.
