29 CFR 1926.453(b)(2)(v): A body belt (harness) was not worn and a lanyard was not attached to the boom or basket when working from an aerial lift: a) On or about 07/27/2022, at the former Roxy Music Store, located at 228 Main Street, in Batavia, New York, the employer did not enforce the use of fall protection to employees working in the basket of an aerial boom lift 14 feet above lower levels. Employees were allowed to apply an exterior finish along the outside walls without the use Personal Arrest Fall Protection Systems such as a harness with a lanyard. NO ABATEMENT CERTIFICATION REQUIRED

Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. a) On or about 07/27/2022, at the former Roxy Music Store, located at 228 Main Street, in Batavia, New York, the employer did not enforce the use of fall protection for employees installing gutters and soffit fascia 14 feet above lower levels. The employer allowed employees to work on elevated surfaces greater than 6 feet high without fall protection. NO ABATEMENT CERITIFICATION REQUIRED
