29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): a) Jobsite, 3047 Hazelhurst Avenue, Baldwin, PA: On or about August 10, 2022, two employees were repairing a sewer line in an excavation that was not fully shored and were exposed to cave in hazards up to approximately 8 feet deep. JM Daugherty Industries, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(a)(1), which was contained in OSHA inspection number 1522776, citation number 1, item number 1a and was affirmed as a final order on 4/26/21, with respect to a workplace located at 404 Union Street, Pittsburgh, PA 15205.

29 CFR 1926.651(k)(2):Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a) Jobsite, 3047 Hazelhurst Avenue, Baldwin, PA, On or about August 10, 2022 the competent person did not prevent employees from working in the trench that was approximately 8 feet deep on the unprotected side with near vertical sidewalls until necessary precautions were taken to ensure the safety of the employees. Employees were exposed to a cave-in hazards while working in the trench that was not fully protected and the shoring system being used was not installed in a manner consistent with the manufacturer's tabulated data. JM Daugherty Industries, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(k)(2), which was contained in OSHA inspection number 1522776, citation number 1, item number 1b and was affirmed as a final order on 4/26/21, with respect to a workplace located at 404 Union Street, Pittsburgh, PA 15205.
