29 CFR 1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about 6/17/2022, at jobsite, employee was working inside of a renovation project patching holes in the stairwell with cement. The employer never provided training to employees so that they may recognize and avoid the hazards that were present on site. The employee injured his right foot/shin from a 5 gallon bucket of cement that fell on him.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: a) On or about 6/17/2022, at jobsite, an employee was working inside of a renovation project patching holes in the stairwell with cement. The employee injured his right foot/shin from a 5 gallon bucket of cement that fell on him. The employer did not enforce the use of personal protective equipment for the protection of the extremities such as but not limited to, protective footwear.
