29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a) On August 8, 2022 and September 29, 2022, the employer did not ensure that one or more method of guarding was provided to protect employees who were assisting with the unloading of the C&M Baling Systems, Inc. horizontal closed end baler. Employees were exposed to hazards created by the hydraulic door locking mechanism. An employee sustained a four finger amputation injury on August 8, 2022, when the employee's left hand was crushed by the locking mechanism for the baler door. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR 1904.29(b)(3): The employer did not enter each recordable injury or illness on the OSHA 300 Log and 301 Incident Report within seven (7) calendar days of receiving information that a recordable injury or illness has occurred. The employer, Claire's Boutiques, Inc., did not enter each recordable injury or illness on the OSHA Form 300, Log of Work-Related Injury and Illness or complete OSHA Form 301 , Injury and Illness Incident Reports within seven calendar days of receiving information that a recordable injury or illness had occurred. Recordable injuries and illnesses included but were not limited to the following instances: (a) On or about August 16, 2022, the employer did not enter a recordable injury on the OSHA 300 Log and 301 Incident Report within seven calendar days of receiving information that a recordable injury or illness had occurred on August 8, 2022, when an employee suffered an amputation injury. (b) On or about August 25, 2022, the employer did not enter a recordable injury on the OSHA 300 Log and 301 Incident Report within seven calendar days of receiving information that a recordable injury or illness had occurred on August 17, 2022, when an employee was injured, requiring a job transfer for 5 months. (c) On or about September 9, 2022, the employer did not enter a recordable injury on the OSHA 300 Log and 301 Incident Report within seven calendar days of receiving information that a recordable injury or illness had occurred on September 1, 2022, when an employee injury resulted in two days away from work.
