29 CFR 1910.178(m)(5)(iii): When the operator of an industrial truck is dismounted and within 25 ft. of the truck still in his view, the load engaging means shall be fully lowered, controls neutralized, and the brakes set to prevent movement. (a) On or about August 8, 2022, an employee was dumping pallets of old baking pans into 40 ton Cohen metal recycling dumpster located outside the warehouse using Caterpillar battery powered fork lift model E5000-AC S/N A4EC221470. The load was raised approximately 8 feet in the air when some pans were stuck on the pallet. The employee dismounted the lift, climbed up the ladder at the end of the dumpster, and with one foot on the ladder and one foot on the PIT mast, the employee attempted to shove the stuck pans off the pallet into the dumpster. The employee slipped and his foot hit one of the levers, causing the tilt bar to move, because the key was not turned off. He was caught between the mast and the forklift. The employee was hospitalized with a fractured pelvis.

29 CFR 1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. a) On 8/8/2022 at 9:30 AM an employee was hospitalized following a powered industrial vehicle accident, but the employer did not report the hospitalization to OSHA until 8/12/2022 at 10:24 AM.
