29 CFR  1926.102(a)(1):  The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about August 15, 2022, at the jobsite located at 2765 Jackson St Oshkosh, WI,  two employees were observed not using eye protection while operating pneumatic nail guns to install asphalt shingles on the roof of a new commercial structure exposing the employees to eye hazards from flying particles.  Injuries could include debris and nails entering eye(s), becoming lodged in eye(s), and potential lacerations of the eyes causing temporary blindness.

29 CFR  1926.501(b)(4)(ii):Each employee on a walking/working surface shall be protected from tripping in or stepping into or through holes (including skylights) by covers.  a.  On or about August 15, 2022, at the jobsite located at 2765 Jackson St Oshkosh, WI, employees installing shingles on the southern side of the steep pitch roof were not protected from tripping and/or stepping into holes.  Five holes were located approximately ten feet from the roof peak and were between the employee's work area and the stacks of shingles.  The employees had to pass within inches of the uncovered holes when retrieving shingles to install.  Stepping into and/or tripping into holes could suffer injuries such as sprained or broken ankles, cuts and contusions, and possible death from falling off of roof.   b.  On or about August 15, 2022, at the jobsite located at 2765 Jackson St Oshkosh, WI, employees installing shingles on the northern side of the steep pitch roof were not protected from tripping and/or stepping into holes.  Three holes were located approximately ten feet from the roof peak and were between the employee's work area and the stacks of shingles.  The employees had to pass within inches of the uncovered holes when retrieving shingles to install.  Stepping into and/or tripping into holes could suffer injuries such as sprained or broken ankles, cuts and contusions, and possible death from falling off of roof.

29 CFR  1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.    On or about August 15, 2022, at the jobsite located at 2765 Jackson St Oshkosh, WI, the employer did not ensure that employees installing roofing material on a new commercial structure with unprotected sides greater than 6 feet above a lower level were protected from fall hazards by a conventional form of fall protection.  Falls of ten feet or more to a hard surface could result in in juries such as contusions, broken bones, blunt force trauma, and possible death.

29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  On or about August 15, 2022, at the jobsite located at 2765 Jackson St Oshkosh, WI, employees accessed the roof on the northern side of a new commercial construction by using the upper half of a Werner 28' aluminum extension ladder that did not extend at least 3 feet above the upper landing surface, was not secured at its top to a rigid support, and did not have a grasping device to assist employees in mounting and dismounting the ladder which exposed employees to slips and fall hazards.  Falls of ten feet or more to a hard surface could result in in juries such as contusions, broken bones, blunt force trauma, and possible death.
