29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent. a) On or about September 15, 2022 , an employee operating the toy stuffing machines was exposed to noise at 501.7% of the permissible daily dose, or an average sound level of 101.9 dB, as measured over 461 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 101.6 dB accounting for the period of 19 minutes unmonitored. b) On or about September 15, 2022 , an employee operating the toy stuffing machines was exposed to noise at 485.5% of the permissible daily dose, or an average sound level of 101.5 dB, as measured over 473 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 101.64 dB accounting for the period of 7 minutes unmonitored.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment had been performed through a written certification that identified the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and which identifies the document as a certification of hazard assessment. On or about August 16, 2022, the employer failed to verify a written certification of the workplace hazard assessment had been performed for employees who operate the second floor stuffing machines. The employer provides, but does not require, hearing protection and safety goggles to be worn by employees working the stuffing machines.
