29 CFR  1926.95(a):Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:  (a)  Jobsite:  On or about August 16, 2022, an employee was not wearing a hard hat while he was working in a 6 foot 2 inch deep excavation.

29 CFR  1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a) Jobsite:  On or about August 16, 2022, two employees were working in an excavation that ranged in depth from 5 feet 6 inches to 6 feet 2  inches and there was no shoring/sloping to protect the two employees from a sidewall collapse.  (b)  Jobsite:  On or about August 16,  2022, an employee (Superintendent) was working in a section of the approximately 6 foot deep excavation that had a trench box in the excavation but the bottom of the metal trench box was approximately 4 feet above the bottom of the excavation.

29 CFR  1926.651(k)(2):Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:  (a)  Jobsite:  On or about August 16, 2022, the Superintendent did not remove himself and another employee from the 5 foot 6 inch deep excavation to 6 foot 2 inch high deep excavation.
