(a )Oak Hill Nursing and Rehabilitation dba Oak Hill Center for Rehabilitation and Healthcare, 544 Pleasant St Pawtucket, RI:  On or about August 16, 2022, and ongoing, employees engaging in direct care of suspect and confirmed COVID positive residents, were not provided with respirators for protection against aerosolized SARS-CoV-2 virus. At a minimum, an N95 NIOSH-certified filtering facepiece respirator is necessary to protect employees from aerosolized SARS-CoV-2 virus.

29 CFR  1910.134(c)(1): The respiratory protection program was not updated as necessary to reflect those changes in workplace conditions that affected respirator use.  (a) Oak Hill Nursing and Rehabilitation dba Oak Hill Center for Rehabilitation and Healthcare, 544 Pleasant St Pawtucket, RI: On or about August 16, 2022, the respiratory protection program was not updated as necessary to reflect those changes in workplace conditions that affected respirator use in that:  1. The program allowed for the use of face coverings and non-NIOSH certified respirators for employees who provided direct care to suspect and confirmed COVID residents. At a minimum, an N95 NIOSH-certified filtering facepiece respirator is necessary to protect employees from aerosolized SARS-CoV-2 virus,  2.  Medical Evaluation records for the use of respirators for employees prior to their fit testing were not available, 3. Respirator fit-testing  records for employees were not available, 4. The individual who was responsible for administering or overseeing  the program was not identified.

OSHA requested the COVID-19 log on January 20, 2023, via email. Additional requests were made by email on January 26, 2023, and January 31, 2023. As of the February 10,2023, the employer has not provided the COVID-19 logs to OSHA.
