29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at the workplace a written hazard communication program which describes how the criteria specified in paragraphs (f), (g), & (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes items (i) and (ii) of this subparagraph: a) 5 Pine Court (Heather Woods Development) in Newark, DE 19702: On or about August 17, 2022, the employer did not provide or maintain a hazardous communication program to include labels and other forms of warning, safety data sheets, and employee information and training as required. ABATEMENT NOTE: A written program shall include description of how the criteria for the following will be met: 1. Labeling and other forms of warning; 2. Material Safety Data Sheets; 3. Employee information and training Additionally, a list of hazardous chemicals known to be preset in the workplace must be compiled. Methods used to inform employees of the hazards associated with non-routine tasks and the informing of contractors of workplace hazards, including a description of the labeling system used in the facility and of the availability of material safety data sheets, must also be addressed. The written program must be made available upon request.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: a) 5 Pine Court (Heather Woods Development) in Newark, DE 19702: On or about August 17, 2022; the employer did not ensure a competent person was on site to make the required inspections prior to employees being directed to enter the trench/excavation. The trench/excavation requiring protective systems was saturated due to wet conditions. The hazards associated could not be verified by those employees on site and when they entered the trench/excavation to cut a broken sewer line it collapsed.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance paragraph (b) or (c) of 29 CFR 1926.652. a) 5 Pine Court (Heather Woods Development) in Newark, DE 19702: On or about August 17, 2022 - the employer failed to protect employees working in a trench/excavation by an adequate protective system. Employees engaged in trenching/excavation work replacing an existing broken residential sewer line. Employees were required to enter and work in a trench/excavation with undermined/unsupported structures and standing water not being removed or controlled prior to employee entrance into the trench/excavation. The water increased the potential of collapse exponentially with the continued use of the excavator being used to assist the employee in the trench/excavation.
