29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.  a) On or about August 17, 2022; Ground and Lower Roof; Employees on the lower roof levels were not wearing hard hats for protection from being struck by materials, debris, and tools including, but not limited to, impact drivers and hammers dropped by the employees working on the upper levels.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) On or about August 17, 2022; Roof Area; employees were not wearing the eye protection while operating portable equipment including, but not limited to, impact drivers while installing a metal roof on a residential home. 29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest system, nor were an employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).   a) On or about August 17, 2022; Roof Area; Employees were installing a metal roof on a residential home approximately 10-20 feet above the ground without wearing fall protection.  b) On or about August 17, 2022; Roof Area; Employees were installing a metal roof on a residential home approximately 40-feet above the ground while utilizing the Deluxe Harness body belt positioning device as a personal fall arrest system.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. 29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  a) On or about August 17, 2022; Roof Area; Employees were utilizing an aluminum Werner 12-foot and 25-foot extension ladder that extended a maximum of 18-inches above the landing to access the upper and lower roof areas.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.
