29 CFR  1910.1048(d)(6): Employees were not notified within 15 working days of receiving the results of formaldehyde exposure monitoring, in writing, either by distributing copies of the results to the employees or by posting the results:   a) On or about October 5, 2022, Vorteq Coil Finishers, LLC did not notify employees within 15 working days of receiving the preliminary results of formaldehyde exposure monitoring performed by The Hartford, in writing or by posting the results. Air monitoring performed in the Paint/Coating Room on August 31, 2022 indicated the  Coater, the Utility and the Lead Man & Entry End Operator were exposed to formaldehyde at 0.45 ppm,  0.12 ppm and 0.041 ppm respectively.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1910.1048(n)(1): The employer did not ensure that all employees who were assigned to workplaces where there was exposure to formaldehyde participated in a training program:   a) On or about August 17, 2022, Vorteq Coil Finishers, LLC did not ensure that employees working inside the Paint/Coating Room and using RC Reduced VOC Lacquer Solvent participated in a training program. Employees working in the Paint/Coating Room were exposed to formaldehyde ranging from 0.12 to 0.45 ppm.    No abatement certification or documentation is required for this item.

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) On December 6, 2022, Vorteq Coil Finishers, LLC did not provide a temporary employee, working in Paint/Coating Room, with training regarding the health hazards associated with hazardous chemicals in the work area. The employee was exposed to chemicals, including but not limited to, methyl ethyl ketone, solvent naphtha, xylenes and titanium dioxide.  No abatement certification or documentation is required for this item.

29 CFR  1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  a) On or about August 17, 2022, Vorteq Coil Finishers, LLC did not establish or implement a written program with all applicable elements to ensure that the respirators did not create a hazard including providing a medical evaluation to determine an employee's ability to wear a 3M 6200 half face tight-fitting negative pressure respirator before it was used in the Paint/Coating Room.    No abatement certification or documentation is required for this item.
