29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) Kingston Hotel jobsite, roof: On or about August 16, 2022, the employer exposed employees to struck-by and falling object hazards in that hard hats were not worn by employees that passed lumber to employees overhead.

(a)  Kingston Hotel jobsite:  On or about August 16, 2022, the employer did not ensure safe operation of an industrial lift truck in use and did not meet the applicable requirements of operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks, in that employees were exposed to potential struck-by hazards.
