29 CFR  1903.19(c)(1):Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  a.  On or about August 18, 2022 at the above address, an employee was required to operate a powered industrial vehicle and had not been provided with training, including but not limited to formal instruction, practical training and an evaluation of the operators performance, thereby exposing employees to struck by and crushing hazards. 29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck safely:  a.  On or about August 18, 2022 at the above address, an employee was required to operate a powered industrial vehicle and had not been provided with training, including but not limited to formal instruction, practical training and an evaluation of the operators performance, thereby exposing employees to struck by and crushing hazards.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a.  On or about August 18, 2022, at the above addressed jobsite, an employee performing roof sheeting operations at nineteen (19) feet five (5) inches, was not protected from falls, thereby exposing the employee to fall hazards.  b.  On or about August 18, 2022, at the above addressed jobsite, an employee performing roof sheeting operations at nineteen (19) feet seven (7) inches, was not protected from falls, thereby exposing the employee to fall hazards.

29 CFR 1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  a. On or about August 18, 2022, at the above addressed jobsite, employees had been provided fall protection training, however, the employer failed to keep a written certification of record.
