Front side of Lot #44: On or about 08/18/2022, the employer exposed an employee to overhead struck-by hazards, in that head protection was not provided to an employee operating a material hoist elevating bundles of shingles to the roof located 24-feet, 4-inches from the ground level.

Roof on Lot #49: On or about 08/18/2022, the employer exposed employees to struck-by hazards while operating Metabo (Model HPT45AB2M) Coil Roofing Nail Guns, in that protective eyewear was not provided while operating these tools at 130 PSI engaged in roof shingle installation activities.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New townhome construction located on Lots 44-49 Ferrington Way, Smyrna, GA 30080. Roof on Lots 44-49: On or about 08/18/2022, the employer exposed employees to fall hazards of 20-feet, 5-inches to the lower ground level, in that a fall protection system was not used while engaged in roofing installation work on a 6/12 pitched roof. b) New townhome construction located on Lots 44-49 Ferrington Way, Smyrna, GA 30080. Roof Dormer on Lot #44: On or about 08/18/2022, the employer exposed an employee to falls of 24-feet, 4-inches to the lower ground level, in that a fall protection system was not provided to an employee loading the roof and receiving shingles from the material hoist using the dormer roof as a walking/working surface.
