29 CFR  1926.102(a)(1):The employer did not ensure that each affected employees use appropriate eye or face protection when exposed to eye or face hazards from flying particles:  (a)JCS Roofing LLC at 1313 North Hazel Place, Sioux Falls, SD 57107:  On or about and at times prior to August 18, 2022, the employer did not ensure that employees were protected from flying particles associated with operating pneumatic nail guns while conducting roofing operations.  This condition exposed employees to eye injuries including the introduction of foreign particles into the eye.

29 CFR  1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a)JCS Roofing LLC at 1313 North Hazel Place, Sioux Falls, SD 57107:  On or about and at times prior to August 18, 2022, the exposing employer did not ensure that employees were protected from fall hazards. Employees were engaged in roofing activities on a 4-in-12 pitch, two-story townhome without the use of a fall protection system. This condition exposed employees to a fall hazard of greater than six feet.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee  exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a)JCS Roofing LLC at 1313 North Hazel Place, Sioux Falls, SD 57107:  On or about and at times prior to August 18, 2022, the employer did not ensure that employees were properly trained on the use of fall protection systems prior to being exposed to fall hazards while conducting roofing work on a residential roof.  This condition exposed employees to fall hazards greater than six feet.
