29 CFR  1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a)SiteWorks, Inc. at the intersection of 41st Street and Valleyview Road, Sioux Falls, SD 57106: On or about and prior to August 19, 2022, the employer did not ensure that each employee conducting work in an excavation was protected from cave-in while installing water line, in that the excavation was measured greater than five feet deep and lacked a protective system, such as appropriate sloping, benching, or shield system.   This condition exposed employees to cave-in and struck-by hazards when performing work in the unprotected excavation.  SiteWorks, Inc.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1578341, citation number 2, item number 1a and was affirmed as a final order on July 26, 2022, with respect to a workplace located at the North Oaks Avenue Addition, Harford Industrial Park Sewer Extension Project, Hartford, SD 57033.  SiteWorks, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1257122, citation number 1, item number 4a and was affirmed as a final order on June 11, 2018, with respect to a workplace located at the intersection of Arrowhead Parkway and South Powder House Road, Sioux Falls, SD 57110.

29 CFR  1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee was not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:  (a)SiteWorks, Inc. at the intersection of 41st Street and Valleyview Road, Sioux Falls, SD 57106: On or about and at times prior to August 19, 2022, the employer did not ensure an appropriate protective system was in place prior to an employee entering the excavation. Competent person was in plain view of the hazardous condition and failed to remove the employee. This condition exposed the employee to struck-by and crushed-by hazards when performing work in the unprotected excavation greater than five feet in depth.  SiteWorks, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1578341, citation number 2, item number 1b and was affirmed as a final order on July 27, 2022, with respect to a workplace located at the North Oaks Avenue Addition, Harford Industrial Park Sewer Extension Project, Hartford, SD 57033.  SiteWorks, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1257122, citation number 1, item number 4b and was affirmed as a final order on June 11, 2018, with respect to a workplace located at the intersection of Arrowhead Parkway and South Powder House Road, Sioux Falls, SD 57110.
