29 CFR 1926.501(b)(10):Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: a) On or about 8/18/2022, at the roof area of the site, Amherst, NY. Employee of Five Star Roofing, working on roofing paper and plywood boards, was not protected by fall protections. Employee was exposed to fall of 8 feet and 14 feet due to the slanted roof. Controlling Employer, Legacy Construction Services LLC, did not enforce the use of fall protections. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(13):The top or top step of a stepladder was used as a step: a) On or about 8/18/2022, at the ground area of the site, Amherst, NY. Employee of Five Star Roofing, while discussing with the owner about roofing transition details, had one foot on the top step and the other foot on the top of a 6-foot Warner step ladder. Employee was exposed to fall of 6 feet. Controlling Employer, Legacy Construction Services LLC, did not enforce the proper use of ladders. NO ABATEMENT CERTIFICATION REQUIRED
