29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: (a)On or about August 19, 2022, the employer, did not ensure that an inspection of the excavation and the adjacent areas was conducted prior to the start of the shift and as needed throughout the shift. Employees of G'Lez Landscaping, LLC. were exposed to cave-in hazards while constructing a retaining wall immediately next to an excavation 7 feet deep and 6 feet wide. The excavation was not inspected prior to the shift by a competent person.

29 CFR 1926.651(i)(1): Where the stability of adjoining buildings, walls, or other structures is endangered by excavation operations, support systems such as shoring, bracing, or underpinning shall be provided to ensure the stability of such structures for the protection of employees: (a) On or about August 19, 2022, the employer did not ensure that each employee in an excavation was protected from cave-ins by an adequate protective system. Employees of G'Lez Landscaping, LLC. were exposed to struck-by and cave-in hazards while constructing a retaining wall immediately next to an excavation 7 feet deep and 6 feet wide, with unsupported caissons within the excavation area that were not supported.
